John Wright was hit by a train near Newark in Nottinghamshire on January 22 2014 and died in hospital nine days later.
The 49-year-old had worked on the railways for 30 years and was working as a lookout on the fatal site.
A Rail Accident Investigation Branch report into the tragedy made a series of recommendations to improve safety following Wright’s death.
The Office of Rail Regulation is now prosecuting the controller of site safety.
A spokesperson for the ORR said: “This was a devastating incident and our thoughts are with the family and friends of John Wright.
“ORR is prosecuting a former rail worker for breaches of Health and Safety law following its investigation into the death of Mr Wright, a track worker who was struck and killed by a passenger train at Newark Northgate station in January 2014.
“A preliminary hearing is scheduled for early March at Nottingham Crown Court.”
